The defamation is defined (article 29 of the Law of 1881) " as any assertion or imputation of a fact which strikes a blow at the honor either in view of the person or of the body to which the fact is imputed ". It is liable to penalty (12.000 euro of fine) from the moment when It is committed to the private individuals by, in particular, any means of audiovisual communication (articles 23 and 32 of the law of 1881), even if It is made under sceptical shape or if It aims at a person or at a body not expressly named, since the identification is made possible by the used terms. Can matters, also, whether It is only the reproduction of a pre-existent assertion;
The insult is, It, " any offensive expression, terms of contempt or rail which contains the imputation of no fact " (article 29 of the law of 1881). Committed to the private individuals by means of an electronic network and not preceded by provocations, It is punished for a 12.000-euro fine (article 33).
